sir, what is the procedure for a decree holder to take over share of the partition property resulting from a partition suit. the opposite party,who s in current possession, has not filed any appeal in this regard. even then, does a mere filing of appeal by the opposite party prevent me from taking over my share or does there have to be a stay in place. how easy are courts wtih respect to granting stay especially if plaintiff is affected by such party.

After the decree in suit for partition, one has to file an Execution Petition before the Court. Please approach your lawyer who handled the partition suit.
