Clarification regarding undivided share of lan

Dear All,

I have purchased a flat in a apartment (in Year 2009)  and there are total of 15 Flats in the same. Apartment was constructed in 557 Sq Yards of land in the year 1995. However the total undivided share of land among all the flat owners amounts to 380 Sq yards only.

Apartment was left unfinished (Completed to an extent of 80% by 1996) only by the builder. who later on absconded after having disputes with the land owner. Balance work was completed by the Society formed by 15 flat owners.

Currently land owner too is not traceable. Builder has constructed 4 shops within the apartment which were not as per plan, and we as society are using for personal purpose.

Now the question is how shall the remaining i.e 177 Sq yards land be shared among the 15 flat owners, if not is there any possibility / way that the remaining undivided share of land be registered in society name.

Regards

RK

The remaining un-built vacant place will be registered on the society's name as common property.  the society on the basis of resolution in an AGM, can move registration formalities along with the copy of the resolution before the concerned registrar.  Discuss the issue in the society's AGM or special meeting for the purpose.
