Clarification on legal heir for fathers property

Hello

i need a clarification on the legal heir of our fathers property

my father had purchased a flat in 1992and after his death in 2004 the legal heir for the property was changed as follows

My mother,myself,my two brothers and my grand mother(she was still alive when my father passed away)

Ie 25% each

My grand mother died last year

can you please tell who are the legal heirs now?

 

My father has two brothers and two sisters

will  my uncle and aunt also become legal heirs or not?

if yes what would be the % split up look like

please advice

Dear Karthik,

As you mentioned in your query, 25 %  to each of you is not correct.  As all of you are five persons, each will get 20% share.

On demise of your grandmother, her 20% share will devolve upon your two uncles and two aunties and one share to your branch.  So, 4% to each of your uncle and aunt.

If my uncle and aunt are legal heirs as well, is there any provision legally to make only myself, my mother and my brothers alone as legal heirs for the said property.

if so what is the process to achieve the same

please advice
