Claiming of title deed documents by the surety holder.

Sir, is it necessary for the surety holder who paid the entire loan amount to the bank to approach the court to claim the original title deed documents under section 140 & 141. Please clarify.

It is not necessary but if surety wants original deed documents no one can stop.

After clearing entre amount of loan surety stands at equal footing of principal debtor.

Sir, thank you for your reply. Sir, one more question I would like to ask is whether section 140 & 141 is applicable even if the cost of the asset is more than the loan amount. paid by the surety.
