Civil service servant conduct and rule

Respected Sir,

I am sending this letter to your attention, that Mr.A, son of B residing in Kerala State, serving central customs & excise department as superintendent with employment code 8524, under the Kerala region.

He is holding the elected position as Secretary of Sree Meenakshy Devasom Charitable society (Reg No.Q 234/2006, registered under societies act in Kerala ), and holding manager position of Sree Meenakshy Devasom Public school position since 2013 July, more than 6 years.

As per the office memorandum  No. 11013/1/2016-Estt.A-III issued by the Ministry of Personnel, public grievances & Pensions-Department of Personnel & training posted in their portal, government servants can hold elective office in anybody in their entire career for a period of two terms or a period of  4 years, which is earlier.

Please let me know does he is subjected to under rule 15(1) (c) of CCS(Conduct)Rules, 1964 – reg, OM No. 11013/1/2016-Estt.A-III , OM No.11013/11/2007-Estt.(A) dated 13.11.2007 and OM No.11013/9/93-Estt.(A) dated 22.04.1994. Is he subjected to this rule and actions against the misconduct? and does he should obtain prior sanction of the Government to hold this elective position and manager position of the school.

Yes. He shall take prior permission to hold an office of charitable nature privately holding of the Manager position of a public school.

If statutory rules do not permit the period for more than 4 years and you have hold that positon already for more than 6 years so how the sanction shall validate it for further period?
