So long as all the ingredients of the Statutory Notice are contained in the notice, it does not matter whether the notice was issued by the payee or an advocate for and on behalf of the payee.

any notice may be given by any affected party without the help of any lawyer if that party knows how to draft a legal notice

Holder of the cheque can issue notice as far as all the ingredients of the section are being satisfied.

Yes cheque holder can issue notice with out the help of an advocate. However it is adivsable to issue notice through advocate.
