Cheque amount is higher than liability

Dear All,

If statement of account balance is Rs. 100/- and cheque in custody of Rs. 200/-. Please advise can file Complaint case under section 138 NI Act. Kindly tell me judgements in favour or against.

if the cheque amount is higher then then the liability, then you need to claim only the liability amount instead of cheque amount.

Hi,

You pl follow the procedure u/s 56 of NI Act. if cheque still to present than endorce in your favor for upto the amount of actual liabilty either amount is filled in that cheque.
