Chapter case 110, 107

we were booked under 326 and later converted into 324 after the chargesheet was filed, as per law we have to sign the ACP bond (chapter case) for 3 years for 326 but now its converted into 324 will the bond duration will be decreased? as for 324 its just one year....


As it was false case against us we have decided to not sign the bond and we have our lawyer for it, its been 5 months we are attending ACP office weekly and its a big harrasment our social life is dieing of, our lawyer is just consoling us that the attendance would get cancel soon, the officers at ACP  office are asking us to sign the bond and get away but we are advised not to sign by many people around as the complainant will flie false NC reports and will get us into trouble, WHAT WILL BE the consequences? what should we do please help

False complaint will be investigation by police people.courts are there to listen the arguments from both thei sides. Lawyers will help to the both the sides. it is upto the court will take the decision on accused.

I think you are being misguided by the ACP office. There are some points to be noted:

1. The case should be heard by a sub divisional / executive or special executive magistrate of your area.

2. The magistrate will give an opportunity to you people to prove your innocence.

3. After hearing, if the magistrate still gives the order to execute the bond, the order should be in writing, stating the reason and the crime you have done.

4. You have mentioned that this is a false case against you, you are right. If you have not signed the bond till date, then the police would have arrested you. They can not arrest you because they know that they have made a false case against you. Take the advantage of this and do not sign the  bond.

5. Write an application to the officer who is hearing your case that you can not come to the court weekly by giving the reason that you are working somewhere / or by giving any other reason.

6. Inquire about the office of Special Executive / Executive / Sub Divisional Magistrate of your area and bring the matter in their notice.
