Can secretary be decided by the rwa

Dear Sir,


I am resident of one of the apartments in Ghaziabad (Vaishali). We have our RWA which was formed last year with the impression that they will work for our issues with builder, improve the ameneties and bring people more closure.

The fact is that the current RWA have completed their tenure in June this year but still continuing and not planning elections. Moreover the Secretary has resigned from the post and asking for re-election. 50% of residents have proposed the name of a person where RWA is not agreeing and appointing another new members at their own wish and comfort.

May i ask the experts here that what is the UP apartment act says once the secretary is resigned and how that post can be filled if election as not happening. Can RWA appoint anyone without having mandate, or resident can force RWA to accept their nominee?

Please provide your valuable inputs.

Has the association got bye-laws? Is it registered? If your answer is 'No' to these questions then the Association is illegal and not valid.

The authorities will not register the Association without bye-laws. Bye-laws will say the tenure of the Managing Committee and the need for holding of elections.
