Bounced cheque

My builder gave undated cheque as damage for not fulfilling the terms & conditions of joint venture agreement to promote apartments. The cheques were bounced. what is the legal remedy. whether the builder can claim it as security cheque and escapes from 138 of NI ACT

Two remidycivil and criminal civil recovery of money criminal if doesnt pay money he will be penalised .
