I have filed a case against some persons for production of fabricated evidence in the proceedings before CLB Chennai bench ( production of forged certificate of postings to show that Notice were send for meetings). These certificate of postings were fabricated here at Kochi. But accused have approached Honorable High to quash the case citing Bar under Section 195 (1) (b) (i)(ii) (iii) of IPC. Honorable Supreme Court in iqbal Sing Marvah vs Meenakshi Sing Marvah have specified that such bar does not exist for fabrication that has happened outside court. Can someone give more clarity on the issue.
