Can one use same audiotape of telephonic talks as proofs in two different cases ? viz (1) As defence in IPC 409 & 420 (2) As complainant in Defamation IPC 500 & 501.

Audio recording is a part of the evidence under Information and technology act 2000, sec.92 and second schedule. Any details about the same available?
