Application for intrim maintenance is mandatory

2 application can be made under DV Interim and main. Interim application is voluntary though recommended since gives immediate relief in form of maintenance and access to shared household. Magistrate goes through summary of the case and normally grants maintenance to the aggrieved.

Thanks Abhi ji, In my younger brother's case, she has filed DV and 125 in Mumbai, and my brother has replied, court has fixed date for arguments over intrim maintenance, we are from Indore and our according to our lawyer in Indore application for intrim maintenance is mandatory,  her lawyer from Mumbai asking for providing citation that no application is required for intrim maintenance.  

 

Please guide in this regard, if application is mandatory, please provide citation.
