The title of the query and post in query box do not provide clear message about what exactly do you want to know.

Post clear and detailed message in query so that someone can respond with relevant links on applicable enactments ( for the corresponding period) , provisions of law, prcedences, citations/judgments etc etc  to help querist (you) and members/Experts, readers etc etc…..facing similar situation so that everyone gets benefitted.

The employer /establishment can draft and frame private rules/policies that provide similar or superior benefits to employees as compared to applicable enactments.The provisions of the applicable enactments shall prevail upon any private rule/policy/agreement drafted by employer and signed with employee e.g; offer letter, appointment letter, HR policy, service rules etc ..

The private rules/policies that provide inferior benefits may get termed as void and fail test of law.

The applicable enactments can be downloaded from the website of authority e.g; Dept. of Labor of the State/Central.
