Sir, I have filed private complaint U/S 420,406 and 506,506 in JFCM Court and later case registered and Judge passed the order to issue to summons to Accused and Summons not yet served to Accused. Next hearing date we have 25th Mar 2018. Now Elders made settlement with Accused. Now I want to withdraw the case . Please advise whether I can withdraw the case Now or whether I need to wait till Next hearing date on 25th Mar 2018. Please advise how to proceed. Thanks for your time.

Yes, you can withdraw the complaint by filing application for compounding the offence before the Magistrate, without waiting for the date posted for hearing.Obtain the copy of the settlement concluded by the elders with the accused, with your consent, and file it along with your application compounding the offence.
