Advice please!!!

Hi,

Me & my wife got married in India in 2008 & then she shifted to UK. We are currently in UK with our 8 year old daughter who hold a British Passport as well alongwith both of us. We also have 2 properties in joint names, 1 in UK & the other in India. Do you think I can apply for Divorce in India????

Yes you can provided you got married in India with proof of marriage, like marriage certificate. Your divorce case filled in India has to be under the marriage Act under which you got married or got marriage registered. As you haven't stated under marriage Act and where marriage solemnised in India it will not be possible be guide you under which provisions you should file for divorce in India and where in India.

The marriage is registered in Mumbai under Marriage Act 1998

Yes, you can file for Divorce under the Hindu Marriage Act.
