125 crPc and divorce

Wife got maintenance under 125 CrPC for last 2 yrs. She stay with children separately. 498 is already pending. Does husband file divorce suit?

You can file divorce case But you have not given facts of the cases already goin on. Consult a prudent lawyer for all you want
