Right of way to our agriculture land.

We have 50 cents ancestral land in village.
On west side of the property , there is a sc colony road. Remaining sides all are agriculture fields. On north side there is a walk way through neighbourhood farmers land. But there's no gentleman agreement for that way.
Now, from north side , neighborhood farmers are not allowing us to enter into our field.
From west side , there is a gramakantam cc road which belongs to sc colony allotted by government. They are also not allowing us from that cc road.
We are in dilemma.
Please suggest us how to get way to reach our land legally.

Rectification deed

Hi sir,

I am planning to buy a plot from X in sy no128/2.
but 128/2 is 7.76 acres .
128/2 is owned by A.
A sold 2 acres to X
A sold 2 acres to Y
A sold 2 acres to Z
A sold 1.76 acres to M.

X applied for Subdivision of survey number.
survey done.
subdivision statement prepared and gave sy no 128/2C in X name.
but mro sign is pending since 3 months.

if I get sale deed with sy no 128/2 now.

after getting mro approval ,

can i rectify document with 128/2C instead of 128/2 by paying minimum stamp duty?

is it possible?

How many days will it take for a subdivision of sy.no in ap?

Survey No 128/2 is of 7.76 acres Purchased By A,B,C,D from X in 1967.

A purchased 2 acres.
B purchased 2 acres.
C purchased 2 acres.
D purchased 1.76 acres.

D sold 1.76 acres in the form of plots by converting land use into Non Agriculture.

Now, C wants to sell his 2 acres in the form of plots by converting land use into Non Agriculture.

but customers asked for subdivision of sy.no 128/2 for registration to avoid confusion of 7.76 acres.

C applied for sub division in meeseva.

revenue officers came for site visit.
they prepared Sub division statement as 128/2 divided into 128/2A is of 5.76 extent and 128/2B is of 2 Acres. they took signatures from neighbour boundary farmers in statement.

for this process 80 days are gone.

still sub division is not done in online.

it is showing as 128/2 in online.

C is visiting regularly Mro office and they said file is pending before collector.
after signing by collector, sub division will be completed.

how many days will revenue people take for subdivision process?

our customers are demanding for registration. we have taken advances from them.

please advice.

Can we confuse court with sale deed?

My father is cultivating 2 acres land in village.
2 acres belongs to 2 brothers.
As per survey settlement record 1954
sy no 44. Is 12 acres.
It is sub divided into 44-1. 4 acres and 44-2. 8 acres
44-2 belongs to 4 persons. A,B, share is 6 acres. C,D share is 2 acres.
Persons C has 2 sons. One is D and another one is E.
After that survey settlement records updated in 1967.
44-1 is sub divided into 44-1,2,3,4.
44-2 is sub divided into 44-5,6,7,8,9,10.
In this record 44-10 is recorded in the name of E son of C with 1 acre and another 1 acre of D wrongly entered as F ( no relation with any person).
My father purchased 1 acre land from D in 1974. In that sale deed old sy no 44-2 is entered and written as out of 8 acres 1 acre land is owned by D is sold to my father.
At that time no online system is there.
Now after online system, F name is entered in computer records. We sold 1 acre property to some person and at the time of registration we gave 3 lakhs money to F and F executed sale deed to some person Though we are the owners.
Land of D and Land of E are side by side each other.
E left village 30 years back and gave his land to us for cultivation. We did not have any agreement between us.
My father didn't pay any land tax till now.
Land is mutated into wife of E. They have pattadhar pass book. Title deed book and ROR-1B. But possession is with my father. We don't have any proof to prove our possession.
Wife of E came back to village and asked us to hand over possession. My father refused to give possession.
They have filed a case in civil court with intelligence that they are in possession and they have records And my father is trying to trespass their land illegally. My father received notice from court. And court gave interim injunction order to E's wife.
We have sale deed of 1 acre which is purchased from D.
In that sale deed no clarity of sub divided sy no. Old sy no is mentioned.
Can we confuse court with this sale deed that this 1 acre belongs to 44-10 1 acre part of 44-2 8 acres executed by D (brother of E.)
We are in possession.
Can we succeed in this case by confusing court with this sale deed?
Please advice.

What is Patta sub division in Andhra pradesh?

I want to buy plot no:6 in sy:no 128/2 from X.
Details:
128/2 is 7.76acres
In adangal
2 acres belongs to X
2 acres belongs to Y
2 acres belongs to Z
1.76 acres belongs to Q.

Mr.Q sold his 1.76 acres into plots (1 to 20).

I have taken Ec for Plot no:6 in 128/2.
In Ec plot no:6 is registered by Mr.D.

I had taken legal opinion from lawyer.

He suggested Sub division of Survey Number is required. Registration has to be done with sub division number.(like 128/2A)

What is sub division ? Please Explain.

I asked owner for sub division.

He said it is a long process. It takes 6 months time.

I don't want to miss this plot.

It is located in best place.

What should I do ?

Affidavit from family members

I am planning to buy a 156 square yards plot in 1 acre venture in village.


My doubts:

1. Land owner purchased this 1 acre in 2003. Is it necessary to take signatures from wife and children of land owner at the time of registration?

2. Land owner has not taken layout approval. But He is willing to pay land conversion fee in Panchayat. Is it ok?

How to change gift deed as sale deed?

My mother purchased 0.30 cents from her father. After registration, we came to know that there are two survey numbers 1/2 is 30 cents and 2/2 is 30 cents. 1/2 is sold by grandfather to other person, but registration not done. My mother purchased 2/2 but registration done for 1/2. Other person asked grandfather for registration. Then grandfather asked my mother to sign registration for 1/2 to other person. My mother did registration. Then my grandfather did registration for 2/2 to my mother. Here problem is my mother purchased 30 cents but registration done as gift deed Instead of sale deed. My grandfather has 6 daughters. Is there any chance for dispute by other daughters?
What is the procedure to make gift deed as sale deed? Please suggest.

Land partitioned before Dec,2004.father died before 2005.

We are 3 Brothers and 2 Sisters. 1.80 acres of Ancestral property of My father shared by 3 Brothers (after death of father) in 1994. we paid Land tax on 3 Brothers Name from 1994.we have Land tax receipts as proof.we dont have registered Partition deed ,because we have pattadhar passbooks.we went to MRO office to computarize these passbooks. They said issued pattadhar passbooks are fake. Suggested us to apply for new passbooks in our mother name. They said after issue of passbook in our mother name, u can partition legally. We agreed and applied for passbook in our mother name. Accordingly revenue office issued pattadhar passbook in our mother name. By knowing this matter, our Elder Sister(who married 40 years back) silently convinced our mother and registered gift deed in her favour of 0.50 cents Land without our knowledge. mother Name in 2017. Today we came to know about this cheating. Immediately we asked our elder sister to cancel the Gift deed. But she is refusing our proposal. More over she is saying "she has a Share in 1.80 acre. She will not cancel Gift deed." We consulted few People for justice in our village. They said legal Points as Per Hindu succession act 2005, 1.women could not ask for a share if the property had been alienated or partitioned before December 20, 2004. 2.Daughters cannot inherit ancestral property if father died before 2005. With this points can we Go to Court and cancel Gift deed?
