Validity of loan documents

Dear Sir,

Please clarify whether the loan agreements/documents dated & obtained on Public Holidays and
Sundays a valid legal documents and enforceable in the court of law.

Residential welfare association

Is it correct to register a Residential Welfare Association by the owners before handing over of flats by the builders? Whether it has legal entity? Whether payments, if made for the purchases of Lifts, Glazing materials etc. can be routed through the Residential Welfare Association Account on

When the banks are merged, whether the employee of transferer bank can get the superannuation benefits of transferee Bank? What about the service conditions and perks?

Pregnancy period

The female employee during the declaration of promotion results from Clerical Cadre to Officer Cadre, is pregnant. The Management has not called her for training programme. The date of joining the training programme has been considered as Promotion Date for all the promotees. What is the position of her seniority among her batch of promotees?

Stagnation increment on account of opt out of promotion

Sir, regarding the sanction of stagnation increment on account of opt of promotion exercise, I understand that the Division Bench of High Court of Madras has delivered as judgement on 02.03.2000. Can any legal expert help me in getting the copy of the judgement by email so that I can help the suffering officers in my organisation. Your timely help is much solicited.

Privileged documents

Please advise us whether the Charge Sheet Official is entitle to inspect the privileged documents. Some of colleagues say that there is a judgement that the Charge Sheeted Official is entitle for supply of copies of privileged documents. No document however personal can be declared as Privileged Document unless it affects the interest of the State. Pl give us proper guidance.

Service tax

We are a registered trade union of Managerial class in the PSU Bank. For our Officers', we have promoted a housing project by engaging a reputed builder for construction of flats. The money is mobilised and paid to the builder. Our bye-law provides the promotion of housing activities for the members of the association. As a Trade Union, are we exempted from paying service tax?
