Respected Seniors!

on the appearance of Accused in 138 NI Act, The Magistrate ordered to furnish 5000/- one surety and after taking that FDR from Adv. Mutually aided Society, on the next date of hearing the same was lost and the person who stood as surety is having the xerox for the same. now what can i do to get the original?
please advice. urgent.

Unnecessary adjournments

Respected Seniors!

An appeal was preferred by the Accused on Conviction before Sessions Judge and on service of notice to respondent, respondent appeared and filed his written arguments and is now for about 10 months, whereas the Advocate for Appellant never turning up and seeking unnecessary adjournments and as well as the Hon'ble judge is pleased to grant the same since past 10 months.
now what is the way to avoid this delay in proceedings, shall i approach High Court or a letter to Registrar judicial will do. please advice.

Procedural law

Respected Seniors!

in a complaint under section 506 IPC, the complainant have not mentioned the time and date of occurance of the offence and the Accused have filed quash. now is there any possibility to fight the said Quash? and is there any citation or ruling by Hon'ble S.C. as its not mandatory for mentioning of time and date in the said offence?

Transfer of case

Respected Seniors,

i filed a batch cases (5 in number) under 138 N.I. Act, before magistrate court whereas 3 were transfered to spl. magistrate court, one is with the same magistrate and another to another Spl. Magistrate. now i want to have all the cases in one court, so want to mave a petition to the Sessions Judge. under hat provisions i can move for getting all the said cases in one court.
Please i request your good self to advice me on the same.

Revision or appeal

Respected Seniors!

I request all your good self to please put me out of confusion on an aspect.

my query is

In a 138 N.I. Act case i am for complainant and the trial court have acquitted the Accused. subsequently i filed Appeal before sessions court for which the Appela is dismissed and judgment of lower court confirmed. now should i go for Appeal to H.C. U/s. 378 Cr.P.C or Revision to be filed U/s. 401."
Please hope i receive your valuable advice soon as possible.

Quash

first of all i would like to thank all my seniors to support me with your valuable answers for my quires.

Mutual consent

Respected Seniors!

Please i seek an advise from you seniors that, a couple who are well settled and financial with a good sound wants to take mutual consent divorce and was got married in the year 2010 and have no children.

so which is the best and quick method to take M.C. Divorce as the guy wants to leave Australia by Feb, 2014. before that they intends to finish the matter as they cant leave together anymore.

Please advice.

I got a case where the Accused is a women ditched by her lover, who already been married to another and now he have filed a case against this lady U/s. 67 I.T. Act by taking advantage of their previous relationship. she got bail and the matter is about to start and yet to receive the copies from the court.
now what precautions i can take in saving her case. please advice me.

Respected Seniors!

my friend filed a case against her husband who left her and married another female in his home town and now even the second wife found him not genuine and Divorced him. my friend filed a case against him U/s. 420, 494, etc., with police station and she obtained the FIR Copy (Xerox). this is done on 08.01.2013 and till now the said police colluded with the Accused / Husband and not filed any charge sheet.
now what is the remedy for her and when and all she is going to the police, she is abused and sent back.
can she file a Writ of Mandamus, if yes what to be enclosed in list of documents? only what she had as of now is FIR Xerox Copy. or any other way to approach? even she gave a complaint in CID Hyderabad with Inspector General of Police. for which no action was taken.
hope i will help out her with your kind opinions. thanking one and all.
