Counter Affidavit to Cr.P.C 125

Que.1.I want to Know from Experts if I can file Counter to Cr.P.C 125 in Just Bold Three Liner Affidavit, the three Liner is as follows:


"I (respondent)Completely deny all the Allegation framed against me, I would also like to bring to the notice of Hon`ble Court that i am ready for Life imprisonment because I cannot pay a single penny as maintenance as i am unemployed nor i am interested in any Cohabition with the petitioner"

Fate of Divorce Injunction Petition?

I had Filed Divorce and Henchmen Injunction Petition in the Family Court, I got Interim Order on Injunction, and Case proceeded for 3 Hearing their after the Opposite Party Went to HC for Transfer of Suits from Family Court to Senior Civil Judge Court and accordingly the HC Ex-Parte Transfered the case from Family Court to Civil Court, From that date onwards I am not attending the Case for 6 months, As I suspect their is Life threat to me as the opposite party is notorious, If I go their for hearing , Now I have 2 Questions:

1.Why did HC did not follow the Family Court act Chapter 8, which was designed by HC itself, while Transferring the case from Family Court to Civil Court which is 38kms away within the same District?

2.What would be the Fate of my Divorce Suit and Injunction Suit as I am not attending the Case for more then 6 months now?

Que.1.Need simplification of the above Text within the Brackets from Section 9 of HMA details of which is as under?

9. Restitution of conjugal rights.- (1) When either the husband or the wife has, without reasonable excuse, withdrawn from the society of the other, the aggrieved party may apply, by petition to the district court, for restitution of conjugal rights and the court, on being satisfied of the truth of the statements made in such petition and that there is no legal ground why the application should not be granted, may decree restitution of conjugal rights accordingly.

Adultery, Going to Sex Workers and Living Relationship!

1.Please explain difference between Adultery, Going to Sex Worker and Living Relations?

2.In all the Three cases their is High risk of Getting AIDS(HIV).Legally these Allegations are very difficult to Prove yet they posses highest Health risk to Other Partners Life, Why does Courts does not consider these parameters suomoto ,when Deciding up the cases u/s Section 9 of HMA for Restitution of Conjugal rights and reconciliation of Divorce cases, the above is True for Both the Partners whether wife or Husband.
