Grant of injunction on the basis of agreement of sale

Good Morning everybody,
I am M A Bijapur Adv.
I want to know can i obtain injunction on the basis of agreement of sale by virtue of which i am in possession of the property concern without seeking the relief of specific performance. pls ans by supporting the citations.

Is it true that a suit has to be started within a short period of time after the contract has been violated in order to get relief from the Specific Relief Act? Is there a specified time limit?

Eviction of tenant

dear experts, my client was a tenant in a premises and a rent agreement was registered for two years. after expiry of the agreement the landlord insisted on increasing the rent @ 20% which, the tenant refused. the landlord refused to increase the tenancy period. but the tenant paid rent through cheaques for next two months. after the landlord stopped receiving rent through cheque, the rent was sent through money order which was also refused. then the landlord filed a suit for recovery of possession and the orders were in favour of the landlord. sir, my question is whether without giving any prior notice for termination of tenancy, is that order valid and good in law. the judge has given reference of a SC judgemnet- M/S Nopany Investments(P) Ltd. Vs. Santokh Singh (HUF)(supra), wherein it was held that "filing of an eviction suit under the general law itself is a notice to quit on tenant". kindly advise further remedy availabe. thanks and regards.

Remedy for non-contesting the suit

Dear Experts,

One “A” filed a civil suit for declaration of title, injunction and for recovery of possession as against four defendants which includes my relative “B”.

All the defendants have contested the suit but unfortunately my relative “B” had failed to appear before the court of law and was set exparte and finally the court was passed a judgment and decree on merits as against all the defendants which include my relative “B”.

Though all the defendants have contested the suit but my relative “B” has failed to contest the suit even though he is having valid documents to disprove the plaintiff’ case.

Sir, my doubt is whether at this stage what can my relative “B” can do and how can he protect his possession since the court was passed a judgment and decree as against all the defendants for return back the possession to the plaintiff.

Kindly advise me, Sir.
