Absconding husband.since 2 years.

A girl ( now 21)of a domestic hand in our house was induced in marriage in a temple by a boy before two years and out of the said relations she gave birth to a babyboy (2+ now) now. The boy is absconding since two years and his whereabouts are not known. The girl has been driven out by parents and is staying with our family with child and is working and the child is in our care. She is not ready to wait any more.How to get divorce in absence of boy? We are ready to take care of child under adoption or guardianship. How to go about, pls guide.

Drt and appleal to vacate award of auction

I was declared defaulter in loan by a cooperative bank and was issued a demand notice in 2Dec.2008. The Bank wwent on accepting repayment even thereafter and till date. In Feb.2010, intimation to take possesion of securities was given to me by the authorised Bank(cooperative)under SRFAES, inspite continuation of repayments against the loan, to tokae a symbolic possesion, (0n 20-2-2010)The Bank also published an Auction of immovable property 15-2-1010 and on 28-8-2011, ins pite of continuing to repay (al most entire interest has been paid up by me). My contension is, that is this legal when on one side the amount is being accepted from the borrower and on the other side, by keeping him in direct, the award it take(without prior intimation) and the auction is declared? Where do I stand legally and what are my rights? Where do I appeal to stop auction? I have proved my bona fide intension by continuing to pay large sums against the loan throuh out.

Guardianship of grandchild

In a tragic accident, a friend of mine lost his only son living behind a widowed daughter in law and a young just born boy child, who is now 4 years. The friend arranged for second marriage of his widowed daughter in law, who is happyly living now. with her consent he kept the grand son for bringing him up, as the only sign of his deceased son.
Now whenever he approaches Banks for depositing money in FDs for future provision in the name his minor grand son, the Banks are asking for Guardianship, he is also willing to make him nominee for his flat/property and other savings. What legal document he needs which will be legally acceptable in all these. What is the procedure. Pleas guide.

Second career as an advocate

I have worked in an Institution on Registrar's Post for 35 years and during the course of my service I had to also assisted in handling legal matters pertainign to the said Institutiona,visiting various courts with lawyers and briefing them etc, which gave me a good exposer to the legal field. Being a law graduate, immediatel after retirement I enrolled myself in Bar Council. Though I am 60+, I am physically and metally fit for my second carreer. I would like to know as to from where do I start now?

Wife threatens 498 for mutual dv

I am married since last seven years and have a daughter of five years. My wife is intending to leave me for another man in her life and is not willing to part with daughter in spite of the fact that I am ready for mutual divorce. Her lawyer is threatening that they will file a false case under 498 if I do not agree with her terms for mutual divorce. How do I handle this, as I do not want to get implicated in 498. Pls.help.

Transfer of flat pending case against buyer

In a cooperative housing society, a member against whom a case is filed for conducting school in residential flats has purchased one more flat in the same Building jointly with his son and is seeking NOC for Bank Loan. The Cooperative Court has given him temporary stay pending filing of the reply by the Society. Can the Society refuse the NOC on the ground that the status quo has to be maintained till the final out come of the case? What will be advisable for the Society ?

A non-owner as 'associate member'

Can an individual who does not own flat in CHS jointly or otherwise with owner, be an associate member with consent of owner ?

Rieghts of joint share holder in chs

I own a property in a cooperative housing society jointly with my son. My son is willing to surrunder his rights in my favour in the CHS matters, as he is preoccupied.
(A)Can I become an associate meber ?,
(B) if yes, what is the procedure? and
(c)what will be my rights and limitations if such a membership is granted to me ? Pl. guide.

Trust by parents for retarded child

A friend of mine having metally retarded son aged 14 years is willing to creat a trust in his favour bequething all his assets to the said trust, spefically with provision of taking care of his son in future, when the parents are not alive.

What is the way out ?
Or is there any other method trustworthy which will ensure the welfare of the son in future to come ?
Please guide.

A school in residential premises

In our CHS a full fledged school is run by a pvt. trust for over seven years and all their classes are housed in residential flats purchased in the name of the relatives of the owner of the school and the number of such flats has grown from two to ten over this period. As the all the members were complaining about this growing nuisance, AGM took up the issue with the owner of the school, who is also a member. He aregued that he has got permission from the Builder prior to formation of CHS and the adhoc committee has also given permission. However, he has not produced such proof nor does the soceity has any thing on the record. The question is (1) Is the then MC right in its decision for such a permission, if at all it exhists? (2) Wehter the Builder has power to give such a blanket permission ? (3) is it binding on the present MC to honour and allow school and its further extension ? What is the remedy available to the CHS to get rid of this nuisance?
