The impugned dispute was between Hindus and Muslims as to title of the said land/property. How far was it correct to give one portion to Hindus, One portion to muslims and one portion again to Hindus? Why could not court Hon'ble judges reach to a conclusion as to which party had the title to land/property involved.
While making an assessment or re assessment u/s 147, the Assessing Officer, can not ask information u/s 143(2)so as to make an assessment of the nature of section 143' a regular assessment. In the case of section 147 assessment, the AO should know the amount of income which has escaped the assessment on the basis of information which has come to his notice rather than determining the income as if he is acting u/s 143. Am I right?
Submission of evidential documents, paper book
What is the opportune time or the only time to submit the evidential material, paper book etc. in a civil suit. If the documents or other material are not submitted at a time they should have been, can an application be made to the court to condone delay and if the court does not condone delay, can it become a ground for appeal after the case is finaly decided by a subordinate court.
