Time period to be mentioned in the notice for payment or performance

What time period we should mention in our notice for compliance by the other party (i.e. noticee) in following cases :

1) Notice for recovery of outstanding amount (How much time we should mention in the notice for making payment by noticee)

2) Specific performance of contract (How much time we should mention in the notice for specific performance by noticee).

Please guide me in the above matter.

Is it necessary that documents should be identified and signed by other layer before it is notarised by the layer who is notarising the document

Land owner expired. What to do ?

We have taken land on lease from one land owner. Now that land owner has expired and his son is asking us to pay rent to him. What documents we should ask from him to confirm that he is only the legal heir of that land owner.

One person harassed and irritated because of other person

From last two months one person is following my friend. That person is having doubt that his wife is having relation with my friend. As per my friend there is no relation with his wife. That person is having many contacts in police department and trying to harass my friend. My friend is worried that police will put him behind bar on the basis of any false reason. As per my friend that person also wants to extract money from my friend. My friend is very much irritated, disturbed and worried. What my friend can do in this situation to protect him legally. Please advice.

Notice u/s. 138 of Negotiable Instrument Act

One party has given cheque to us in January 2010 for Rs.100000/- which was dishonoured but no notice was sent u/s. 138. In February 2010 that party has paid Rs.30000/- by cheque which got cleared. Now total outstanding amount is Rs.70000/- for which party is not making payment. The cheque of Rs.100000/- which was given in January 2010 was with us. We have re-deposited same in March 2010 and it was again dishonoured. Can we send notice u/s. 138 and claim for Rs.70000/- which is actual outstanding amount as on today.

Please advice.

Member of a Co-operative Housing Society

One member of a co-operative housing society has given his flat on rent. He is not staying in that society but he has given his name for becoming committee member of the society. Can that person become member of a committee even if he has given his flat on rent and he is not staying in society. (he has given his name only for becoming member of the committee and not for chairman or secretary or tresurar). Please advice

Transfer of flat in the name of wife on death of her husband

One person has purchased flat in Dombivali, Maharashtra in 1992 but proper stamp duty was not paid at that time and the agreement was not registered. Now that person has died last month. As per his will (not registered) property has to be transfered in the name of his wife and even in the nomination form filed in society of the building, name of his wife has mentioned.

Now for tranfering that flat in the name of his wife (1) whether Probat is required because property is within the jurisdiction of Bombay High Court and (2) whether registered document with proper stamp duty paid will be required to submit to society. If yes, which document has to be stamped and registered.

Please advice.

Marrige by widow

One widower (around 55 years) having son and married daughter wants to marry with his relative who is widow (around 52 years)having two married daughter. That widow is also ready for the marrige but two daughters of that widow are not ready because caractor of that widower is not good and they wants to stop that marrige. How they can stop that marrige legally. Please help and advice.
