False allegation of determining the sex of baby

Hi,

My wife put a false allegation of determining the sex of a baby when she was 13 weeks pregnant in the affidavit submitted as an evidence in the CRPC 125 case. However, this is completely false. In fact, I googled and learned that the sex of a baby cannot be determined until 18 weeks of pregnancy.

The CRPC 125 still in evidence stage and I am paying the interim maintenance ordered by the Hon' Court.

Do I have to wait until I prove not guilty in all cases ( 498A, DV, and 125) or is there anything I can do right away? Please suggest.

False allegation for determining a sex of baby

Hi,

My wife has put a false allegation on me about determining a sex of the baby during our 125 CRPC / DV / 498 A case. She was about 13 weeks pregnant as per the date she mentioned.

I searched out on google and there is no accurate way to identify the sex of the baby until that time of pregnancy with a simple ultrasound.

Please help me with supported findings and how I can fight these cheap false allegations.

125 maintenance and dv act interim

Hi All,

An order has been passed by the Honorable court in 125 to pay the interim maintenance from the date of application. The other case DV is also in consideration state.

Can that big amount be divided into multiple installments?
What will be the mode of payment better for us?
Do we also need a receipt or affidavit of that she got money from us? She only submits a written acceptance in the honorable court, which is added in our case file.
Will I be getting more maintenance amount in DV act?
I have applied for the name deletion application for my sister who is living abroad. Will that be considered first before argument on interim maintenance in DV case?

What will be the best strategy to fight all false case on me (498, DV, and 125)?

Cross-exam questions to elicit wife’s independent nature and non-abla-naari status:

Did you study in XYZ college?
Was that college in your hometown or outside?
Assuming it was outside: Did you stay in a hostel then?
Assuming it was in same city: How far was the college from your home? How did you reach college and back home from college? If she says she went by bus, then ask: Did anyone accompany you in the bus like your father etc? If she says no, then you can use that as argument later that if she can finish 3-4 years college course and travel in bus on her own everyday; what stops her applying, taking up a job, and travel by bus on her own now? Has she lost her ability to move out of home, go in bus/auto whatever, do productive things simply because she got married?
