WRIT

WHETHER I FILE A WRIT OF CERTIORARI FOR DIRECTION TO GOVT, REGARDING THE MATTER OF VEHICLE REGISTRATION, THAT IS THE GOVT GIVE THE R.C. BOOK NOTE THE NUMBER ,BUT I SUGGEST THE GOVT PRINT THE NUMBER IN THENUMBERPLATE ALSO, THIS KIND OF WORK IS DONE BY THE GOVT IS VERY EASY. NO ONE CAN MISOPPROPRIATE IN THIS MATTER AS THEIR WISH IS IT POSSIBLE?

demand notice from an advocate regarding payment of telephone bill

I am having land line connection from Tata Teleservices since long time. Since all our family members are using mobiles, I thought of discontinuing landline connection and I stopped payment of bills. One of the representative visited my house and asked for payment of pending bill amount of Rs. 700/-. I told him that I do not require the connection any more and asked him to adjust from my deposit amount of Rs. 1000/- with them. He suggested that if I clear the above bill amount of Rs. 700/-, they will provide only incoming service for 3 years with the deposit amount of Rs. 1000/- lying with them. Immediately I paid Rs. 700/- and he gave me the acknowledgement. But in the acknowledgement there is no mention of his offer of 3 years incomeing service with deposit amount. Recently there were number of calls from Tata Teleservices asking me to pay the bill amount. Virtually I am not using the land line for the last several months. The bill is only for minimum amounts.

Now I have received a demand notice from one of their advocates asking me to pay balance amount of approx Rs. 3000/- within 7 days otherwise necessary legal proceedings both under civil and criminal laws will be initiated against me.

With the receipt of Rs. 700/- available with me, can I take a stand of whatever the sales guy promised me.

Change of Advocate on record.

Resp. Members,
Can a litigant change his advocate on record if he is not satisfied with the services rendered by that advocate? For filing fresh Vakalatnama, NOC of earlier advocate is required or not? Kindly explain. Regards.

Sir,
In case where employer on one hand issues the cheque against salary and on other hand stopped the payment of this cheque, whether case is to be filed U/S 138 N.I.Act or complaint U/S 420 IPC, what would be better?

Filing of Memo of Appearence

There is always a doubt to me whether in a criminal case while filing a bail application or an anticipatory bail application whether it is memo of appearence or vakalat that needs to be filed along with the concerned bail application. In the lower courts it is the memo of appearence that needs to be filed and some of our advocates feel that it is vakalat that needs to be filed. When refering to the Sec.303(3)cr.p.c. I think I am correct. Is there any suggestion or advice to me in this regard?

my query is- if petitioner can file review petition in person against the dismissal of slp without assigning any reason in supreme court and what is the procedure for the same .please guide me with points and authority for the same.also i will like to know if there is specific format for the same. can the petitioner file the review petition by e filing in supreme court. if yes what is the procedure

Sir, whether FIR to police is must for decalring any one's death according to 108 Evidence Act.

One army man was missing since 1980. His wife got the information through a letter from army that her husband is missing from Silong on 8 February 1980 and instutcted her to inform to army if he is at home, otherwise he would be decalerd dester. Wife didn't lodge FIR and could not find his where about. In 2010 she applied for decalration of his death. After recording ample oral evidence court dismissed the suit due to lack of FIR . Whether information from Army is not sufficient ?

Please guide and refer any citation in this regard
