Purchase of agricultural land by non-agriculturist.

I am from Pune, Maharashtra and want to purchase agricultural land in agricultural zone. I am not an agriculturist. Can I do so?

Execution of Decree.

In a suit, possession of suit property is granted to plaintiff for himself and for defendants no. 8 and 9 and decree drawn accordingly. Suit property in possession of defendant no.1. In execution proceedings possession warrant has been granted in favour of Plaintiff to take possession of suit property for himself and for defendant no. 8 and 9. In what manner defendant no.8 and 9 can claim their share of suit property? What care should be taken so that their names will appear in 7/12 extract? At the time of execution of possession warrant by bailiff what should be done by them. I am on behalf of defendant no.8 & 9. Request to kindly advise. Thanks.

Gift deed - stamp duty exemption in maharashtra.

Mother wants to give gift of her own 1BHK flat to her elder daughter. Now, in Maharashtra, stamp duty for gift to a person in blood relation is Rs. 200/- from 24.4.2015. On the birth certificate, the name of mother is not appearing. What proof daughter is required to give before the sub-registrar office that her own mother is giving this property to her by gift. Can mother make an affidavit that the person to whom she is giving the property is her own daughter as there is no other proof? What are the other documents which can be treated as valid proof to avail exemption? Please advise.

Disposal of joint property on decree of divorce

Respected Sirs,

Husband H filed divorce petition against wife W. H and W are having a 2 BHK flat as joint property. Husband has not made any pleadings in the petition. Court has not framed issue as disposal of joint property. If husband H succeeds, and Court remains silent on disposal of joint property, will H be able to remove the name of W from the title deeds of joint property? What remedy is available to wife W so that it will not happen like that.

Delay condonation in summary suit.

Respected Sirs,
In Bombay City Civil Court, Summons for Judgement has been issued against Defendant in summary suit. There is a delay of more than one year in filing leave to Defend. For filing delay condonation application, is it required to issue chamber summons or can it be directly filed before the Court on the next hearing date?
Kindly advise suitable course of action.

What is the scope of Order 41 Rule 11 of CPC? Can court summarily dismiss appeal under section 28 of Hindu Marriage Act by invoking powers under Order 41 Rule 11 of CPC?

Admission of appeal before district court.

Resp. Members,
I have filed a civil appeal in Pune District Court. It has been filed and registered and Court has been allotted to this appeal. Now what will be the stages till end? What is the stage of admission of appeal? What are the chances of getting it dismissed before issuing notices to the other side? Please advise.

Appellate powers of district court.

Under Section 28 of Hindu Marriage Act, 1955, what are the appellate powers of District Court. In my case, divorce petition has been allowed by Civil Judge Senior Division, however, claim of lumpsum maintenance has been rejected. Hence, I want to prefer appeal. Can District Court amend the judgement and decree only to the extent of maintenance and reverse only those findings keeping decree of divorce as it is? What are the powers of District court under Sec.28 of Hindu Marriage Act? Please advise.

Divorce petition - lumpsum permanent alimony

Resp. Experts,

Filed Divorce Petition under section 13(1)(ia)on the ground of cruelty and sought lumpsum alimony from Respondent. Court has not framed separate issue for lumpsum alimony. Is separate issue for lumpsum alimony required to be framed by the Court? If cruelty is established, then in the absence of separate issue for lumpsum permanent alimony, is Court bound to consider the case for lumpsum permanent alimony when it is prayed for?

Are there any supporting judgements?
