Adverse possession

There is encroachment on our land for many years. The encroachers came in possession based on agreement to sale on Rs. 5/- Stamp paper from a fraudulent POA holder. No such POA was ever given. Am I right in my contention that since entry was based on agreement the plea for adverse possession cannot be taken as defense by the encroachers.

Urban land ceiling

My land was under ULC 10(3) notification. Land deemed to be vested in government. After repeal in 2007 do I need to file suit in high court to free the land from ulc proceedings? There's encroachment for last 40 years. When does it start to be adverse?

Court proceedings

My case running in court is never called out. And latter new date is uploaded online. Where can I complain against the staff for this.?

Decree null and void

Society filed suit in district court for specific performance to sign conveyance deed and got decree in its favour in 2007. Land affected by Urban land ceiling so Decree non-est ( ulc act repealed after the decree was passed). They then (post repeal) proceeded in executive court and Conveyance deed signed by a court commissioner. Thereafter society went in for a development agreement (Redevelopment). Redevelopment is complete. As decree is non-est and void, Is the Conveyance deed, Redevelopment deed void and is redevelopment illegal? What action needs to be taken by the original landowner?

Urban land ceiling. public purpose

Dear Sirs/Madams,
Our land was under ULC but not acquired. I understand that it's now outside ULC as per repeal in 2007. Do I need to go to high court to get any declaration? All records are in my name.
Also when we applied us 21 exemption for construction of dwellings for weaker section. The orders read " After looking at the situation of the land and papers it is noticed that this land is better suited for public purpose. Does this mean my land is now required for Public Purpose?

Declaration suit and not to disturb peacfull posession

Dear Sirs /Madams

1)I want to know if I can file a declaration suit of property via partition deed without asking for possession. As I am in talks with possessors for Redevelopment. ( avoid hefty court fee)

2)Can I file for declaration of property rights for 20,000 ft & not to disturb peaceful possession, for only 1000 sq ft as I was in possession of this land till 2014 and stay on construction claiming I am still in possession?

3) To file criminal tresspass case is Partition deed enough as I do not have 7/12 extract ( cancelled by Talathi with fraudulent order)

Urban land ceiling 10(3)

Dear Experts,

My Land had been under Sec 10(3) and 10(5) but the entry is not reflecting in the 7/12 the Ceiling office too has no records of my case. We had filed a case against acquisition by ULCA and procured a stay in 81, this case was disposed in 91 with the comment that stay "may" be vacated. I have a letter from the Talathi that there has been no acquisition or reservation in the whole of the survey no. that my land is in. Is my land free of Ceiling by virtue of the repeal act or do I still have to go through Court and get the Land restored? Has the 10(3) notification become null or is my land still vested with Government?

Compensation urban land ceiling


Dear Sir/Madam,
My fathers land was under 10(3) & 10 (5) ULCA Maharashtra in (1978). The land has not been acquired nor any compensation paid and thus as per the Repeal act ( Voltas Case)should be returned to him and he is the sole owner of the land. My Father was not allowed a scheme under weaker section as the competent authority claimed that it was necessary for public purpose. It is obvious that this is not the case as the land was not put to any public use in 30 years when that the law was in force. However when this land was deemed to be Government land some people have encroached on this land and built permanent structures and staying there for the past 33 years. Now can I demand other Land as compensation for this piece of land which we should have been rightly able to enjoy. Title via partition deed

Dear Sir,
My 7/12 has been messed up by Tehsildar. I want to file suit against encroachment and do not have the time to get 7/12 rectified. Will my registered Family Partition deed be enough to file a suit and prove my ownership?
