Visitation rights

My Case of Judicial separation is in Distt Court Sangrur ( Punjab). Respondent (wife) does not appear in the courts on any date. next date is 15.4.2015 and this time summons has been served by hand. what if she does not appear/answer the notice ??? can ex-parte decree be given this time. One other thing i want know is visitation rights. since my wife is living in Fathgarh sahib distt. so should file separate petition or a application under same petition ( Judicial separation) be filed.

how the insuarnec claim amount will be distributed between legal heirs

Dear Experts........Pls advice....My brother died in road accident, he has personal insurance policy which will pay 17 Lack rupees as insurance claim. He has family of 5 ppls dependant on him. My brother (Decease) His 1)Wife 30years,2)his Daughter 1.5 years, 3)Father 58years, 4)mother 50years, 5)unmarried sister 24 years ................pls advice.....legally how the amount will be distributed between them, what %age or share will be given to whome.

Non compliance of District forum order

Dear Ld. Members,

I had filed a consumer complaint against Delhi Vidyut Board which was decided in my favour. DVB went on appeal and the same was dismissed in-limine by the State Commission. DVB compensated me as per the district commission order. Now DVB has been privatised and taken over by New Delhi Power Company Limited. They have sent one notice to pay some amount which was the cause for filing the complaint.

Please tell me whether to contempt petition in the District Forum or the State Commission. The value is less than 20 Lacs

Non-implementation of Gazetted Holiday

Can a pvt charitably funded educational institution remain open and conduct classes on a gazetted holiday in the beginning of session? What is the meaning of gazetted holiday ? Is it not a violation of fundamental rights of students ? How to proceed so that the defiant Principal and its officials are punished ? What all essential evidences have to be gathered to prove the same operation ?

ARBITRATION AND RECONCILIATION ACT 1996

I WANTED TO KNOW IF I WANT TO FILE A EXECUTION PETITION IN SENIOR DIVISION COURT THEN CAN I FILE THE SAME IF YES ACCORDING TO WHICH SECTION CAN I FILE THE EXECUTION PETITION IN SD COURT GUJARAT THIS HAS BEEN A DECREE AS AWARD WAS NOT CHALLENGED BY TH OPPOSITE PARTY AND THEY HAVE KNOWLEDGE ABOUT THE SAME FOR MORE THEN 6 MONTHS HENCE IT HAS BECOME DECREE.
AS IT IS ALREADY FILED IN SD COURT AND NOW THE OPPOSITE PARTY SAYS THE SAME PETITION IS NOT MAINTAINABLE BY SD COURT GUJARAT AS THE PRINCIPLE JUDGE CAN ONLY ENTERTAIN SUCH PETITIONS I.E. DISTRICT JUDGE AND NOT SENIOR DIVISION JUDGE HAS POWERS TO LISTEN TO THIS MATTER OF EXECUTION AS PER ARBITRATION ADN RECONCILIATION ACT.

MACT Date of accident wrongly mentioned in claim petition

Sir,
I m representing respondent in a MACT 163-A petition,in petition date of accident is mentioned as 28-8-07 ,in fact date is 28-09-07 that is also mentioned as 28-9-07 in FIR submitted by petitioner,all medical bills & MLR is of dated 28-9-7,date is also wrongly mentioned in affidavit tendered in evidence of petitioner by petitior itself,can i avail benefit of this mistake of petitioer,this mistake is repeated five times in claim petition.Thanks

Negotiable Instrument Act

In a case of NI Act before me :-
A cheque provided by the 'Cooperative Credit Society' Registered under (Maharashtra Co-operative Societies Act)the accused issued such to the complainant. while observing the cheque it didnot look like a cheque generally issued by the Banks, and Which has been specifically mentioned on the upper side " Only for Member"and also the Cheque No. is made by rubber stamped.

Pls tell me what is the authenticity of the said cheque, whetther it is negotiable instrument. now the case is for evidence (Cross of Complainant)with citation

Appeal Dismiss by Punjab & Haryana Court

Dear Experts

We have made a criminal complained against Mr. Madan Lal & his three maternal uncles (MAMAs) on 16th Dec 1998. They were all charged U/s 323,324 & 325. In that case myself, my brother and my father got injuries. Case was under trialed in the Hon'able Lower Court, Kosli Distt. Rewari (Haryana) after 10 year a decision was came that accused charged for one and half year prision with Rs. 300 fine each. But accused appealed in the Hon,able Higher Court i.e. District & Session Court Rewari. After 2 year Hon,able court made some amendment in the decision i.e. that was a family dispute and accused realsed on Probation of 2 year and awarded a compensation of Rs. 15000 to us. But we were not satisfied with Hon,able Session Court decision and Refused to take the compensation. We made an appeal against the decision in Hon,able Punjacb & Haryana High Court in Dec 2008. But Hon,able high court dismissed our appeal on family dispute and long time of case. So you are requested please clarify that
1. Court can dismiss the appeal on said groud. Becouse Mr. Madan Lal is Our Cousin and his MAMA were came outside with and in the case my brother's left hand was broken and my self and my father got head injuries.
2. If court dismiss the appeal than we have another option for re-appealing.
3. If we can not re-appeal than our compensation Rs. 15000 claimed or not.

DIVORCE DEED

ONE OF MY CLIENT TO AVOID LITIGATION EXECUTED THE DIVORCE DEED WITH MUTUAL CONSENT.
1. I WANT TO KNOW THE VALIDITY OF THIS DEED IN THE COURT OF LAW.
2.IS IT REQUIRED TO OBTAIN DECREE FROM THE COURT.
3.CAN ANY PERSON GET DECREE ON THE BASIS OF THIS DEED EASILY.
3. CAN THEY GO FOR MARRIAGE WITH OTHER PERSON ON THE BASIS OF THIS DEED, IF YES - THE VALIDITY OF THE THAT MARRIAGE.
