Loud speakers

Sir,
I understand that there is a law that loud speakers cannot b used beyond 10 PM. But in our locality, loud speakers are put even after mid night during many festivals. I can say nearly 100 days in an year we have lot of disturbances. The volume is such that we get headache.
I went to police station to tell them about this. They controlled one or two days, but they are telling to give written complaint in future. But I am worried of written complaint because the area is really bad and full of goons.
I would like to know following:
Why police cannot act without complaint? Is it not their duty to maintain law and order?Do they need some complaint? If this is the case how our safety can be ensured?
What else we can do without disclosing our ID.

Electricity connection

Dear Sir,
I have agricultural property and I need to get Electricity connection for irrigating the land. However my neighbor does not allow me to take connection from Electric pole located in his property. I need not lay any poles in my property. I just need to take direct connection from the pole located in adjacent plot.
I want to know is Electricity connection is not an essential requirement in Karnataka? How can I proceed in this case?

Dtcp approved sites safe or not?

Dear Sir,
Is DTCP approved layout is safe to buy? Can legal heirs make claims on these properties later in case the property developer has not looked properly or the seller of the original property has not given correct information. What will happen if such litigation arise at later stage? Who has to fight in court?


When we buy these sites, what we must look for from legal aspects?

Is DTPC approved layout is safe to buy? What will happen if such litigation arise at later stage? Who has to fight in court?

Section 85 and 86

Dear According to section 85,
Nothing is an offence which is done by a person who, at the time of doing it, is, by
reason of intoxication, incapable of knowing the nature of the act, or that he is doing what is either wrong, or contrary to law; provided that the thing which
intoxicated him was administered to him without his knowledge or against his will.

Also it says:
(i) Voluntary drunkenness is no excuse for commission of a crime

But section 86 slightly contradicts (I feel). 86 says:
In cases where an act done is not an offence unless done with a particular
knowledge or intent, a person who does the act in a state of intoxication shall be
liable to be dealt with as if he had the same knowledge as he would have had if he
had not been intoxicated, unless the thing which intoxicated him was administered
to him without his knowledge or against his will.

(ii) Sometimes intention on the part of the person who is drunk can also be
assessed from the nature of weapon used in the commission of the offence. If a
person uses a weapon which is not dangerous and the attack results in death, a malicious intention cannot be drawn against him even though drunkenness is no
excuse

So how voluntary drunkenness cases are handled? I am bit confused.

Case of cheating

Dear Sir,
I had made an agreement with another person to buy a property. Agreement was made on 26/11/2007 by paying 1 lakh advance. As per the agreement, the property was handed over to my possession from the day of the agreement. Due to certain delay, the registration could not happen and the agreement was renewed from time to time by adding note at the end of the document and finally the property was registered on 8/6/2009. But during this period, the seller transferred the water pump set connection (Not the pump set itself, but only electrical connection to that) to another property that he owns, without my knowledge. So he basically cheated me though he gave the possession of the land to me. Also in sale deed, he clearly stated that pump set connection is given to me (Though RR number was not specified).

So I went to take legal help and appointed one layer. He sent legal notice on 21/01/2010 to reinstate the connection and seller replied that he will not agree for this.

Subsequently criminal suite was filed (I am not sure why layer went for criminal suit instead civil) and court rejected the case just last week (Yet to get the order copy and hence reason is not known).

Now my question is:
Can I file a civil suit now (I do not get anything from criminal suit. So civil is better I thought)? What is the time limit for filing the civil suit? Is it from the date of sending legal notice to the seller or is it from the date of the offense?

Bying agriculture land in karnataka

Dear Sir,
My father owns ancestor property (Inherited from his father) in Karnataka. I was earning more than 5 lakh rupees per year so far, but recently (August 2012)I resigned from work to do research. Am I eligible to buy agriculture property in Karnataka? Whether present income is considered or average of few years is considered based on IT return? Where is the exact rule we can find? Please note that my name is not included in the ration card of my father as I was staying elsewhere.
