Revenue

Respected Seniors, I have an extent of Ac. 1-34 Cents which was devolved on my favour by virtue of will dated 30-09-2008 executed my paternal grand mother.

My paternal uncle claimed the said property by create a forged will. then i filed a suit for permanent injunction against my uncle in Junior Civil Judge's Court. Meanwhile temporaty injunction granted in my favour. At present suit is pending for trail. Now i am cultivating the paddy in the said land.

Now paddy crop was damaged due to cyclone. the Government has granted damage amount to cyclone effected farmers. My land was covered in damages list. The revenue authority is refusing to give damage amount to me due to matter is pending before court. My contention is i am cultivating land and also i got temporary injunction is in my favour with regarding to possession of the said property. The Govenment granted damage on crop but not on land. Hence i entitled to receive the said damages. ( If damages on land then subject to the judgement).

In the above circumstances basing on temporaty injuncion and possession in my favour whether i entitle for crop damage due to cyclone effect which is granted by government or not.

I request you to give recent citations of Honourable High Court and Supreme Court in my favour on this aspect.

Municipal Law

Respected Seniors,

I purchased agricultural land an extent of Ac. 0-75 Cents in Municipal Area. Later on I came to know that in the middle of the above said land an extent of Ac. 0-17 Cents was marked as Park in Municipal Records.

Now i am ready to pay cash as per the Governemnt value of the above said land of Ac. 0-17 Cents to the Municipality or i will give my another alternative land for the equal value in the said area to the Municipality.


Now I want to know that what is the procedure under Municipal Laws to delete the above said park in the said land in municipal records.

Registration of Sale Certificate

Respectyed Seniors,

Mr.'X' purchased a vacant site in public auction conducted by a Court in execution proceedings in the year 2006. Later Mr. 'X' deposited entire sale consideration in the court and obtained a sale certificate and also possession of the vacant site from the court.

Now Mr. 'X' is put the said vacant site for sale. But purchasers are refused to purchase the same since the said sale certificate was not duly registered in concerned registrar office. In fact Mr. 'X' not registered the said sale certificate in registrar office till now.

Now my doubt is Mr.'X' can sell the said vacant site without registration or not. If he sold the same is it legally valid or not.

2nd time suicide statement.

Respected Seniors,

Within the 2 years from marriage wife was committed an attempt to suicide for the harassment of her husband and her in-laws. At that time she was admitted in hospital and local magistrate was taken her marana vangmulam. At that time of giving marana vangmulam she was not revealed real facts with regarding to her attempt to suicide since prior to that her husband and her in-laws threatened that if the real facts are exposed then we will kill your son. With the fear of her son she could not reveal real facts with regarding to her attempt to suicide before the magistrate.

As per the version of the doctors still she is in danger of her death. But she is ready to reveal real facts with regarding to attempt to suicide.

Now my doubt is, 2nd time statement is valid under law by the said wife for her statement to attempt to commit suicide.

Provincial Insolvency Act

Respected Seniors,

One Mr. 'X' borrowed some amount from Mr, 'Y' and registered a deed of Agreement to Sale cum GPA with regarding to his property to Mr. 'Y'. his property. In the said deed Mr. 'X' admitted that he received total consideration of the said property and given all rights with regarding to his propety (ie. Possession, interest, title) to Me. 'Y' in the year 2008. There in Mr.'X' admitted that Mr. 'Y' can execute sale deed on behalf Mr. 'X'. in the name of others.

After 2 years Mr. 'Y' executed a registered sale deed in his favour.

subsequent to the date of sale deed and with in 90 from the said sale deed Mr. 'X' filed a petition under Provincial Insolvency Act to set aside the sale deed which was executed by Mr.'Y' in his favour.

In the said petition Mr. X taken a defence that in the year 2008 while he was in intoxication Mr. 'Y' obtained some signatures in the emply stamp pepers and Mr. 'Y' played fraud on him.

In the above circumstances what are the remedies available to the Mr.'Y'.

Promissory note

Respected Seniors,

One Mother and her Son borrowed some amount from one Mr.'X' and executed a promissory note in favour of Mr. 'X'. the said promissory note was scribed by her son who is practising advocate. In the said promissory note it was not mentioned the name and discription of her mother in the body of the said promissory Note. But both are signed on the affixing one rupee revenue stamp.

What is the fate of the said promissory note.

land acquisition

Respected Seniors, Government acquired 5 Acres of land by giving compensation of Rs. 1,00,000-00 per acre which belongs to the 8 persons. After taking compensation from the RDO the said 8 persons filed a petition in High Court for enhancement of Compensation. High court given direction to RDO for conduct enquiry to assess the real value of the said property and also HighCourt given a direction to the petitioners to file a OP in lower Court.
Later on 6 persons are filed a OP in lower court and 2 persons are not joined as parties in the said OP due to lack of knowledge. Then court enhanced the compesation from 1 lakh to 3 lakhs per acre. Now the above said 6 persons are ready to take their compesation with their respective shares.
In the above circumstances is there any suggession to the said 2 persons to get extra compensation awarded by lower court with their respective shares. In fact theabove said 2 persons are not a party in the above said OP but they are parties in a petition filed by them in High Court.

Registration Act

Respected Sir, Mr. X purchased immovable property from 'Y' for Rs. 50,00,000/- and gave an amount of RS. 15,00,000-00 towards an advance and obtained un registered agreement on Rs. 100/- non judicial stamp from "Y" on 30-05-2007. In the said agreement Mr. 'X" agreed that the remaining balace would paid within 3 months ie. 30-08-2007. But subsequently "X" fell down in financieal crises. at present he is not in a position to pay the remaining balance to "Y".

In the above circumstances is there any remedy to |Mr.X to get advance amount ie. Rs. 15,00,000-00 from Mr. "Y". infact there is no mistake in the case of Mr. Y.

Provisions of IPC

Respected Seniors,

Two brothers namely X &Y jointly purchased a property. It is purely self acquired property of the said Brothers. The said two brothers and their wifes are died intestate. After some years only son of Mr. X created a gift deed infavour of his Son (ie grand son of Mr. X) with regarding to the above said property. There in he mentioned as there is no children to Mr. Y. In fact Mr. Y have a daughter. She claimed half share of the said property and also she wants to prosecute son of Mr. X since he created a false document in favour of his son by concealed the facts. What are the sections applicable to the said problem under I.P.C. to prosecute the son of Mr. X.
