Gift deed

Have some queries on the Gift Deed with respect to Moveable properties:-

1. If the Gift Deed is executed wherein moveable assets are gifted to the DONEE and if something happens to the DONOR prior to execution and/or preparing the WILL, then will the Gift Deed be questioned? Is it necessary to mention all the moveable assets in the WILL (including the ones that the DONOR has already gifted via the Gift Deed to the DONEE)?

2. Can Fixed Deposits that are yet to attain maturity, be gifted by the DONOR to the DONEE via the Gift Deed?

3. Assuming if one of the heirs come to know that there are some more bank accounts and/or some moveable assets which have not been mentioned in the WILL (these are the ones that the DONOR has already gifted via the Gift Deed to the DONEE) and if the DONEE produces the Gift Deed which shows that the bank accounts and/or moveable assets which are missing in the WILL have already been gifted via the Gift Deed, then, can the Gift Deed be challenged by the Heir?

Rights of imla malik - request your guidance

If someone is a chawl owner(Imla Malik) since a long time and has been paying all the property taxes. Does not have proper documentation.

The land owner is someone else and the property is going under SRA. Owner of the land and the developer has entered into some kind of agreement.

The developer says that imla malik does not have any right on the property and that if the name of the imla malik is mentioned in the Annexure II, he is entitled to one flat/rent.

Q. Does the right of imla malik cease to exist in this scenario?
Q. If the room is sold to someone else, does the imla malik loose right for getting flat/rent under the sra scheme?
Q. Maximum imla malik can get under SRA scheme?

Conveyance

'A' is the absolute owner of a larger plot and had entered into an agreement with 'B' where A gave B full, complete, absolute and irrevocable right to develop and construct and sell a part of the larger plot.
Later on 'B' entered into a development agreement with 'C' and assigned him the same rights for the same plot that 'A' had given to 'B'.
'C' completes the construction and enters into various agreements with the purchasers.
The purchasers have formed a Society and are asking for conveyance with respect to the part of the larger plot where the building is situated?
Whom will they have to approach 'A', 'B' or 'C'?

Can proposed respondent be allowed to take for inspection of documents

Hi,

I was hearing a matter in a court wherein arguments were going on between the Plaintiff and the Proposed Defendant.

The Plaintiff has filed an amended application to add the Propsoed Defendant as party defendant to the case. The Proposed Defendant had given them a notice to provide inspection of documents which did not materialise. The Proposed Defendant then made an application requesting the court to direct the Plaintiff to provide inspection of documents. The Plaintiff in its reply stated that there is no provision in law which allows a proposed defendant to ask for inspection of documents.

Q: - Can Proposed Defendant ask for inspection of documents and/or request the Court to direct the Plaintiff to provide inspection.

Sarfesai proceedings

Hi,

I am a law student and have certain queries under SARFESAI proceedings

a) Can a tenant be removed under SARFESAI proceedings?

b) Can a bank forcibly evict a borrower/guarantor/tenant without obtaining an order under section 14 of the Act?

c) What is the procedure for sale or "Auction Sale" under SARFESAI proceedings?

d) How many times can the aggrieved party approach the AAIFR / BIFR?

e) When does OTS (one time settlement) come into picture? Does the Bank have the power to revoke OTS.

f) Can the high court intervene in the order that has been passed by the DRAT?
