Name change

We purchased shares when our daughter was living with us in her name which was at that time R.Sumrata Murthy. Then her name was changed due to surname hassles to that of Sumrata Krishna Murthy. Now all her financial, educational, property are in this name.

Her shares are still in the previous name and dividend warrants are coming in that name.

Many dividend warrants are lost and not encashed due to this and demat also is not done.

What should we do now? Is a simple affidavit is enough? Is it to be notarized? Or a court order is necessary?

Transfer of Property

The process of Transfer of property or alienation of title of land between a buyer and a seller consists of two distinct aspects. One aspect is the extinguishment of the title of the seller and the other is the creation of the title of the buyer or acquirer. Is this explanation right?

quash of G.O.s

Dear Experts ,Here my friend ,& along with his brothers & mother was executed individual notarised plots agreements on 5/- rupees five rupees stamp papers in 1984-1986 in favour of co-oprative society the society has been terminated in 1979.Due to missappropriation illegal things stood by society and the same was counducted an enquary byDeputy co-op registrar and terminated the society in 1979, the secretary fruadly missguided the land owners keeping in dark & fruaduantly done the notary of said plots acoording to 1974 society agreement .in 1984 to 1986 .
Here my friend along with his family members executed An Conditional G.P.A. in favour of society in 1984 in favour of said self styled secretary. and it was Revocked in 1988 .& same was given in paper publication .in these mean time the said terminated society secretary was fruadly entered into registrations on conditional G.P.A .To the individual members beyond the scope of conditional G.P.A. of fake society terminated society , WITH OUT OBTANING MCH.TOWN PLANNING ETCS PERMISSIONS , & the government was regularised the plots on fake house tax receipts, & on un-valid notarised plots & un-valid section 5/A REGISTRATIONS ,the house tax receipts all are fruadly obtained from mch .CAN My friend have any chance in courts to QUASH The G.O.s which was given by fruadly by authority from 2002 to still date by taking Huze bribes from un-valid notaries members & un-valid registrations members. as above mentioned plots matter kindly give such suzesstion on said my friends problem were to approach ,hence request thanking you sirs.

marrying a widow - muslim marriage

Sirs,
My son got married in mid Jan 2009 (Christian Marriage). After two and half months, requested by them my daughter in law was taken to her mother’s place for medical attention and rest. She was conceived at that time. As assured by them, they refused to send her back after two months, saying that her health was not good (which was not true).
She is a bank employee and she was attending her office. Now it is more than thirteen months since our daughterinlaw left our place. A male child was born in November 2009. Many efforts on our side to bring her back were in vain. There were letter correspondences, allegations, counter allegations etc. They wanted my son to leave us and to live with his wife separately, which has been placed by them in writing. From day one of married life my son is not accessed to his wife’s income or any information about that. Now my son has reached a point that he should go for divorce and re-marry. At this juncture a Muslim friend approached and pleaded to marry his widow sister (having one year old son). He also said that he need not divorce his wife which may enable her to rejoin if she realizes/wishes. My son is having slight inclination towards that idea. My son is a central govt. employee.

If my son convert to Islam and marry that widow will any legal problems arise in future?
Also please answer any query which you feel that I have omitted.

Recognition of Law degrees

Hi

I would like to know that is it compulsory for a student to have 45% in graduation to get addmission in 3yrs LLB. If so then why are univ. which are even recognised by Bar council allowing candidates to write the entrance exam to any graduates.
Also in the BAR COUNCIL INDIA website in the section CHAPTER II
Standards of Professional Legal Education
No. 7. Minimum marks in qualifying examination for admission it uses 'may be'.Can anybody explain this.

Dear sir,
I am having a joint family includes father, brother(married )& myself(married). I and my brother doing a service. My wife looking a business of transport.we are living a separately but our ration card is on under family group. Initially I have given money for the purchase of land near to our fathers land and it is registered on both name (i.e.me&my brother ). After that I purchased one land by way of Transfer sale deed agreement in which I have shown my individual purchased above land. Now I again sale the 2nd time purchased land & done sale deed agreement .But my brother objected made a application to land dept. to not enter the name purchaser on 7/12 documentas . The purchaser now pressurizing me to settle the issue with brother as this property is a joint property. Can my brother eligible by way of HUF ? We separated our 7/12 but not decided physical locations till date we are doing whole by way of external farming. Also I & my wife have a separate Income tax files but we have not shown this individual purchased transactions on IT RETURN as this a old transaction which I have made cash through my salary. Please advise me next step.

Mumbai Bar Admission

Hi,
I have passed my LL.B. degree in May 2008 from Mumbai University and have currently moved to the USA. Do I need to be physically present in Mumbai if I need to apply for the SANAD in Mumbai(i.e. Mah & Goa Bar) or is it possible to send my representative and the required documentation & fees. I need to apply for the California Bar exam and need to submit proof of admittance in India. Its not possible for me to travel back to India at this time. Also, I would be ok if I need to provide any Notarized Authorization (US Notary) to my brother or father to do the requisite documentation. Any advise or information would be greatly appreciated.

Getting remarried to the same partner

Dear All,

I am looking for a legal advice / suggestions.

I got married to a Christian girl two years back under the Hindu Marriage Act and we have been staying together. My my wife had converted into Hindu religion as per the law to get married.

We had got married without informing our parents at that point of time. My wife is still using her original name so far and hasn't changed it as yet ,as we wanted to keep our marriage a hidden truth to the world until we got consent from our parents.

Now we have disclosed it to our parents that we would like to get married. For which both of our parents have happily agreed. However they still don't have any idea that we are already married to each other. Now the question is

1. Can we re-marry again with each other.
if 'yes' is that legal? and what would
be the procedure.

2. Can my wife convert herself into
a Christian again. if yes what is
the procedure.

3. Can we re-marry under the 'special
marriage act',

4. If none of this is possible can we
register our marriage under different
marriage act or same act.

Also it would be great if anyone can suggest us any alternative solutions on this.

Card settlement at Lok Adalat

Dear Experts

I did settlement for my HSBC credit card at Lok Adalat to be paid in 6 Emi.Now, being jobless for 4 months in a row. I'm unable to pay the agreed Emi.HSBC men come to my place time and again and threaten.I've made it very clear to them, why I'm unable to pay.They threaten of court order and talk harshly to my mom.

I don't know what could be the likely consequences.

What can I do? Please help and guide.
