Contract agreement

Dear Sir,

Can we enter in a agreement now for a work / service which has been started already? Eg. A service was started on Jan 11 and we are entering into agreement with the service provider now in a current 100 Rs stamp paper.

Is it valid one or not. Please confirm

Purchase of Farm or Agri land

Dear sir,

I am planning to buy Farm/Agri land to do agriculture in big way. The cost of property may be nearly 80 lkhs. But I will borrow some money from others which may be unaccounted.( cash).

Is it have any legal problem, or it will treat like binami purchase? This purchase purely for doing agriculture by me.

Please confirm that I can buy in this way?

Minimum Period for employment agreement

Dear Sir,

Please inform any minimum period shoul required for the employment agreement. Normaly companies making employment agreement for 1 year. But in exceptional case any minimum period is mentioned as per law like 1 month or 3 month?

We are doing a turnkey project and we have only above supervisor catogery staffs in our company. In this situation which insurance is better to our employer as well as employee. Is workman compensation act or Personal accident?

Is workman compensation is mandatory?

Please give the detail ( Rules / Sections ) for annual leave encashment & accumulation.

Is labour law about Leave encashment is applicable to contract employee also? or any other law or rules available?

Over time rules in Kerala

Dear Sirs,

We have a new project in Kerala and we engaged EPC contract. our manpower is only management staffs like Engineers, Senor Engineers managers etc( not workers or labours). Since it is a on site job our normal working hours are 10+1.
As per labour law 8 hours daily working time and 50 hrs OT for a month is applicable ( as per my knowledge ). But in our case it may go more if we will keep daily working hours as 8 hrs. we are ready to pay more money to staff if they worked more hours. But my question is " the rule of 50 hr OT per month". In our past case many time the OT hrs exceed 50 hrs. Also we dont want to increase manpower instead of giving OT. If the staffs agreed to work for 10 hrs per day, is it possible? please clarify.

Over time Charges


Dear Sir,

Please inform me that what is the % of salary should calculate for Over time salary/wages as per Labour law, is it restricted % for all or depending on the employer? ( Can employer fix the rate their own?.)

And the % should be on the total salary or only on Basic.

Please clear the doubt.
