Din of foreign nationals

Dear Experts,
Can you please advise, whether Pass Port of foreign national shall serve the dual purpose as Id proof and address proof for DIN application of a foreign national.
OR
We need to submit a separate proof of address.

Liability for dishonour of cheque

Dear Experts,

Please opine wrt sec. 138 of the NI Act.

A cheque was issued without any date. There was no dispute about the liability. How ever, the cheque was disnonoured on account of stop payment instruction from the drawer. The cheque was drawn in the capacity of a partner on behalf of partnership firm.

In the above circumstances, what are the civil and criminal liability of the signing partner/ other partners/ firm.

Penalty for delay in remittance of TDS

Dear Members,

Please reply with reference to statutory provisions and judicial pronouncement.


Whether a deductor can be treated as an assessee in default u/s 201 for delay in remittance of TDS? In this case, the amount which remain to be paid is interest only.


If the answer to above is in affirmative, whether the deductor can be subjected to penal provisions u/s 221(1)?


Whether the case law, "Shreeniwas And Sons Versus Income-Tax Officer, 'B' Ward, Asansol, And Others.[1974] 96 ITR 562, will come to the rescue of the deductor?

Demerger and intangible assets

Sir,

Now a days big business houses, including Government, outsource their activities, mainly to reputed and experienced contractors. The experience is commonly known as credential in commercial parlance.

If a company is demerged into two company, whether both the reasulting companies can use the credential in agreed ratio.

Kindly opine.

Joint Ventures

Joint Ventures can be in Corporate form(when the joint venture is registered as a company) or can be in non-corporate form(by way of a written Momerandum of Understanding)

My question is, whether the 2nd type of joint ventures are essentially in the nature of Partnership. Whether, the provisions of Partnership Act shall apply to such joint ventures, subject however to, the MOU.

Whether the holidays falling either before or after the period of leave are treated as leave or holiday, either as per law or custom.
