Release deed

Hello respected people,

I own a property jointly with my Ex Wife and now she wants to opt out her name from her share, so we agreed on a sum of settlement for her to release her share and give me her release deed, which is to be registered in the registrar's office. However this property is also on a joint loan . Please advise

Sale deed correction

Hello Repsected experts,

My late father had purchased a property in 1988, and registerd the sale ded the same year, Taxes, khatha, EC and betterment charges , building plan is all up to date with the authorities. However the issue with sale deed is:

1- The geographical directions mentioned in the schedule are wrong. ( i.e. what had to shown in the east, has been shown in the north etc...)

2- The sale agreement also has the same mistake

3- Buyer , Seller and the witnesses for this land transaction are not alive.

How can I rectify the sale deed now?

Your advise will be highly appreciated.

Ex wife's rights

Good Evening respected people.

If a couple is divorced for a year and have a property jointly registered. but now the Man wants to sell it, But his ex wife is not even interested in the property dealings. What should be done.

The property is on loan for the last 10 years, all the EMIs have been paid by the MAN, Initial Down payment by him, Taxes by him. What if the lady ask for the share, and the Man does not want to part with her as she did not contribute. but just because she is jointly registered.

Transfer of khatha

Sir,

We are Sunni Muslims. Family consists of Mother, 2 Sons & 1 Daughter

Our Late father's property is under litigation . The case is about a small portion of it is claimed to be road by the neighbor, filed with BBMP. Currently we have acquired a Status Co on the same. This property is of 2 sale deeds in which one of them is litigated and jointly we made 1 khatha (A) for both the sale deeds. My brother is insisting on getting the Khatha transferred to my Mother's name . You advise will be great, Thanks - Mohamed

Legal heirship

Hello Respected experts,

My query is, My late father passed away on 12th Jan, 2014, and we are left with Mother, 2 Sons & 1 daughter. What is the process of applying for legal heir ship, As he is left us with a property ( which is with litigation with BBMP) and a Bank account with no nominee.

Kindly advise, We belong to bangalore.

Am from muslim sunni family, My father passed away this month, we 2 brothers, 1 sister and a mother in our family. The self earned property of my father has no will or nominees after him. so what is the next step in transferring to our names, your advise will be highly appreciated

Display of notice board

Hello Respected sir/ Madam

I purchased a revenue land in 1980 , My neighbor also purchased in the same year. Both our sites is located at the end of the layout, at the end is a nala. Between both the sites, there was a vacant position of 500 sft. With mutual agreement, my neighbor proposed to me that is should buy that small and attach to my site. So i approached the land owner and did the same. In 1988, my neighbor approached me for a small portion from site to construct his staircase. I agreed and executed a sale agreement. but after measuring and found that he had occupied extra than we both agreed for. so hence did not get the land registered. and so he approached the court and the case was filed, the case came in to favor of me. and he had to return the land to me. However he filed for an RFA in the high court. Meanwhile the layout was taken over under the limits of BDA in th year 2005. My neighbor approached the BDA court and filed for a case stating that extra space between bot our lands is a road. and BDA court passed an judgement for khatha cancellation and we have filed for a status co maintenance in the high court. Now my neighbor has a erected a board on his property pointing towards ours that our property is illegal and trespassers will be prosecuted.

My question is

1- Since both the cases are in the court, Is the displayed board legal. as i have checked with respective authorities and found that no one has given him the permission or authorization. who and ow do i approach to remove the

2ndly, he has broken a portion of the wall running between the 2 proprieties, Can he do that while the case is still in the court.

Khatha

Dear respected sir/ Madame.

My father purchased a revenue land in 1987 measuring 2400 sft ( 60x40), and purchased another piece of land adjacent to this one 1n 1988 measuring 600 sft ( 20 x 40 ). the second piece was a continuation of the road in between 2 sites, which was end at the layout. the road was not continuing anywhere. BBMP took over the area in 2005 under there limits and jurisdiction. We applied and got the Khatha for the entire land as one measuring 3600 sft ( 60 x 60 ). We then got our house built on this entire land , paid betterment charges, Tax until date. An have an 'A" khatha issued by BBMP. In 2007 the neighbor filed a case against BBMP as the first respondent and my father as the second respondent for retaining back the 20 x 40 as road again. Commissioner of BBMP issued and order of Section 114, where he has ordered for the demolition of building on that portion and the khatha has been cancelled. Kindly suggest what should we do. would we loose that piece of land as road , and cant we stop the demolition and can we restore back the Khatha again?
