Unfair investigation of Tax Evasion Petition by IT Officers

Querist : Anonymous (Querist) 28 June 2010 This query is : Resolved
I have filed a Tax Evasion Petition against a person but the Tax offender was influential and he bribed the officers at IT office and they gave him clean chit. I am not been given any details of the said investigation but just being told that he is not found guilty.

What remedy do i have? I have already made complaint to senior IT officers but nothing happened. Can I approach High Court or any other suitable remedy for getting fair invesgtigation of Tax Evasion Petition?

You should not make allegations like bribary so cassualy unless you have got the proof.

You cannot approach the high court for initiating action by the income tax department against a third person unless it is a matter of public interest.

i have seen some cases where action is initiated by the deptt on tax evasion information by some person. But its upto the department to take the appropriate action.

The so called tax evasion petition is just an information to the department. The informer have no right to file an appeal etc against the action initiated by the department on the basis of information received.

You have got sufficient replies in the forum section on your queries.

If you are confident of the information you posess, file a petition with Finance Minister and CBDT. But if it is trivial and non specific, please don't waste your and authorities' time.

If you have grievance, you can share your petition in this section without naming the person and any specific reference.

This will enable the Ld experts to let you know whether it is worthwhile to persue the matter.
