Adversary system of Justice:

(Querist) 30 August 2008 This query is : Resolved
Should India do away with Adversary system of justice?
Murali Krishna (Expert) 30 August 2008
Dear Assumi,

You know very well that a majority of the world legal systems are following adversary system of justice. The advantage of the system is that the adversaries put forth their arguements before a judge/(private judge in case of arbitration matters)and the issue would be decided in accordance with the law of the land. Here the parties will have the protection of the law of the land and the system.
Being one among the common law countries, it is quite natural for our country to follow the system and all our laws are developped accordingly.

I could not presume any system other than adversary one. If this system is not there, what other kinds of legal systems can we have?
