Querist : Anonymous (Querist) 04 June 2010 This query is : Resolved
What is the history behind the procedure -moving advocate during enrollment?
Devajyoti Barman (Expert) 30 October 2010
Consult the Bar Council of your state.

But i want to know through out our country
Parthasarathi Loganathan (Expert) 31 October 2010
BCI must arrange for publication of database related to all enrolled members with full profile for information to general public. This is not impossible.
R.Ramachandran (Expert) 31 October 2010
Sincerely speaking, I have not understood the question of Anonymous.
As regards the view of Mr. Parthasarathy, yes I agree. But that has to be done by respective State Bar Councils. Delhi Bar Council was attempting to do that a couple of years back, which would show the complete details of the Advocate including the photograph of the Advocate. Now the BCI website is quite defunct, efforts are on to revive it by the new members.
Parthasarathi Loganathan (Expert) 31 October 2010
BCI should initiate earnest steps to engage top class IT professionals in the country to get this job done. It would pave way transparency and better communication between the clients and the advocates. In the present scenario, without learning the complete profile and track record of advocates, clients entrust the job and land themselves into inordinate legal procedures. State Wise publication would suffice to start with.
R.Ramachandran (Expert) 31 October 2010
Dear Mr. Parthasarathy,
While I agree with you that there should be a data base maintained by respective State Bar Councils containing the registration particulars, address, enrolment number, photograph etc., of the Advocates, I do not think the Bar Councils are expected to or can give any "profile" of the Advocates. It will then be indirect way of advertising. An Advocate is an Advocate as far as Bar Council is concerned. Thus, except that the client would be able to go to a registered Advocate (instead of getting into any touts masquerading as Advocates) by seeing the Bar Council Website, it will not benefit them to know the exact profile of the Advocate or the Advocate's track record. Even the 'track record' of any Advocate would depend upon the facts of each case that he handles. An Advocate may be brilliant in law, but if the facts of the case does not support him, then he would lose the case. That does not, ipso facto mean that the Advocate is less learned or lacks experience.
What I can understand is that if a lawyer is experienced and has been handling varied kinds of cases, naturally he will gain reputation at the bar and based on that one can approach him. But, the fees that would be charged by that Advocate would commensurate with his standing, which probably most of the clients may not be able to afford - forcing them to settle for Advocates with less calibre / experience.
Parthasarathi Loganathan (Expert) 31 October 2010
I concur with your views Mr.Ramachandran. But basic details of Advocates like Photograph, Date of Birth, Enrollment date, Qualifications, Address, Contact details, Experience, Exposure in a specific branch of law, etc need to be published by the Bar Council of India.

This would also help even advocates to learn and know about each other. We can also track our law college mates with whom most of us have lost complete touch. That is my intention.
R.Ramachandran (Expert) 31 October 2010
The Bar Councils have no means of vouching for any Advocates Experience, Exposure in a specific branch of law, etc., so I would not expect the Bar Council to publish it. From the date of enrolment, one can understand the years standing in the bar. [This again need not be so, for there may be many persons who might have enrolled but would not be practising for whatsoever reason]. Bar Council can only go to the extent of indicating bare minimum particulars [surely not expedirence, exposure in a specific branch of law etc.] of Advocates enrolled with it.

OK Something needs to be done to get the BCI site out of defunct status. At least an alumini club could suffice.
