wages to non striking workers during strike

(Querist) 02 June 2010 This query is : Resolved
During strike some workers attended the office & marked their attendance but due strike production of that is nil. My question is whether it is obligatory on the part of employer to pay wages for that day to non striking workers. Thia company is having manpower more than 5oo employees
mahendrakumar (Expert) 03 June 2010

Unless it is shown that you did not work in spite of being present in the work spot and if you have evidence to show that you had worked to the extent you could under the circumstances prevailed, you are eligible for wages. Company cannot withheld or deduct your wages for that period.
