the provision of 138 of NI Act itself describing about ssuch offence and when it is applicble, viz... when there is any legally enforcible debt only this provision is applicable, but not given for surioty or security

If liability is up to the amount of cheque even then such cheque deposited for the purpose of security if bounced fetches section 138 NI act.
