EPF and ESI coverage

Sir,
Ours is an ICAR institute, and engaged 33 workers as casual workers based on Hon'ble High Court of Kerala Judgment. They were working with effect from 1-4-2009. We have not started subscribing to EPF and ESI contributions because of our ignorance. Whether we have to pay both the workers and employer contributions with effect from 1-4-09 for opening the accounts. We are planning to join the EPF and ESI subscription immediately. Kindly advise.

Though you are liable to pay both the shares as ignorance is no excuse but practically the share of the workers can be demanded from them and can be deducted from their salaries in installments.

Yours is an institute not factory.Any establishment engaging more than 20 employees is coverable under ESI & EPF Act and also with Shops & Establishment Act. From the day when you engaged 20 and above staffs/workers from that day it self your estt. is coverable do not delay you will be penalised for delayed days by both the Act.
