(Querist) 20 March 2010 This query is : Resolved
Is there any rules, law or judgment where it is directed to deploy security guard in ATM counters of Bank ? If there is any please provide me or link.

Provision of Security Guard is a option left to individual banks as per guidelines issued by RBI in force.

Thank you for your reply. I went to SBI atm, no guard there. I try to use my card, but its not worked. I can't dispense card, transection freezed. Then i get out. Some hours after i checked again and find that 30000 withdrawn ed from atm. POLICE VIDEO reveals that a gang using jammer doen that. What is the recourse available to me to get the money back from Bank. Bank act as a trustee so i feel they should repay me. Please advice.

Please refer the matter to the bank where you maintain this ATM account and seek their guidance

Then the matter stands resolved. Since there is always an upper ceiling limit of any cash withdrawal through ATM, the amount mentioned by you debited through ATM is to be dealt by the bank involved through Reconciliation methods. Let us close the topic for now

Matter cannot be ended. Here the question is what to be done in his case as he has been cheated under the garb of ATM being maintained by bank. Such erring bank which do not maintain any guard cannot be absolved from its duty to protect its machines which are been controlled by antisocial elements through their jammers.

What an ordinary customer can do if even though slip showing withdrawal of amount, no actual cash is coming out and when customer reaches to bank, its officials refuse to even entertain his complaint and meanwhile some other person manages to keep that money in his pocket.

Such things cannot happen without direct or indirect lethargy, involvement of the bank staff so such customer is fully entitled to initiate criminal as well as civil action against all responsible officers of such bank.

Mr .Tapash whether it is a credit card or through debit card which has been used by you. If it is credit card report immediately to the local police station and with a copy of your FIR approach BANKING OMBUDSMAN your query could be resolved. If it is debit card approach your banker it might entertain your complaint.
