sir, my forefathers got there shaare of property which we are residing now and the neighbouring plots also comes under the same khetian but the matter is our neighbour is forcible doing construction work on the proposed land due for demarcation.

Show all the documents to your Local Advocate and seek the opinion and follow his guidance like obtaining legal heir certificates etc in your names and get the concerned property transferred to your name mentioning the boundaries and then legally proceed against the neighbor. You could serve an Legal Notice regard to this immediately. Discuss in detail with your Local Advocate.

Your neighbour has to construct on his part of the land. If he is encroaching on your land then you have to take legal action against the neighbour. First, try to amicably settle the dispute otherwise you can send legal notice and later on approach civil court against your neighbour. Further, you can also approach the local police station and file a complaint against him.

Discuss with local Advocate and try to take stay on the construction if the construction is infringing any of your lawful right.

When the land is in your share and possession, how neighbour can raise construction ?
If so, obtain permanent and mandatory injunction from jurisdictional civil court.
It would be advisable to consult and engage a local prudent lawyer for better analyses of facts/ documents, professional guidance and necessary proceeding.
