Ancestral property

Querist : Anonymous (Querist) 02 June 2020 This query is : Resolved
We reside in a property built in 1935 by our great grand father
We want to preserve it
It has stake also of other 4 siblings of our father
How do we find out how much we need to pay them to preserve property?
Ours is 1st floor terrace house.1st floor have tenants
Can tenant n other stakeholders push us into redevelopment?
Raj Kumar Makkad (Expert) 02 June 2020
This is not a legal question rather is of mutual consent of the parties which even depends upon the circumstances. If the said building is in dilapidated condition and requires its redevelopment then the consent of other siblings of your father do matter to fulfill your desire. Eviction of the tenants is possible through the court if no mutual settlement takes place for personal necessity. Better you reach to a mutual agreement/settlement/arrangement with other siblings of your father and sort out the solution.

Mr. Goyal has just repeated his previous reply by agreeing with another expert. What is the use to write down such agreement when subsequent expert has agreed with you.

Sometime emotions a person are associated with the property, they do not want to part with the said property. Other co-sharers twist the arm of such person may call it blackmailing due to associated emotions. For getting the desired results, you may have to pay more than the market value to keep the property.
