Amount taken by maternal uncle for paying his alimony.

My maternal uncle took money from me in form of draft in name of his wife to pay her alimony. Now he is not returning my money and rather says that, the money is given to his wife so I should ask his wife.

Please help.

Legally you can not make any claim to your Uncle.s Wife Or even to your Uncle in the absence of any proof to prove it as loan

Any remedy depends upon the evidence you can adduce to prove that that the draft amount was for settlement of the alimony which your uncle owed to his wife.

Mr.P.Venu -- Retd Govt Officer=. Purpose of Money used is different. Whether the money given by the Querist is a Loan given that would be the question which would need legal proofs to make a Legal demand by the iQuerist

The draft he took, got submitted in court and later got withdrew by his wife.

Purpose of the Draft or to whom it was submitted will not serve your purpose. Legally you should have the evidence to prove that the money given by you is a Loan

If you are capable collect a Post Dated Cheque from your uncle for the amount in a very polite and convincing manner.
