Harassment call

(Querist) 24 February 2019 This query is : Resolved
I'm messaging you to inform you that I'm getting lots of harassment calls from the collection team for the recovery of my credit card payment. I have been abused by calling me fraud and calling me as dog, asking me to resign the job. threatening me that they will call to my office and they are doing the same. I have lots of call recording where they are threatening me. I was about to make payment the reason I didn't pay because the bank official commented me that I'm barking like dog. One more guy calles me and says if you can't make the payment then resign your job. I need an apology letter from the official then only I will make the payment or else I won't. I complaint to ombudsman. Please help me.

You should make the payment within the specified period, you should not stop the payment of your dues under any trivial
pretext, apology letter from the official is your personal matter you can not stop payment of your dues under that pretext. You are rendering yourself for legal action.

Firstly these dogs are recovery agents not employees of the bank. These bastards are goons and work freelance, go get list of debtors with details from the individual banks and start making abusive calls on behalf of the bank although no bank authorize them to make such phone calls. If you contact the bank directly and explain your problem, they'll workout it an amicable and decent manner.
Next time getting abusive call from recovery agents, call them at your home and bash them to teach lesson of life.

1. Recovery of payment of any defaulted amounts has to be done thru Legal Proceedings and not by threatening or intimidating or demoralizing, the defaulter.

2. You can file a Police FIR, requesting investigation and charge-sheet, for offences like Threatening & Intimidation against the person, supported with all relevant supporting documents.

2. IF the Police does not take action, THEN you can file private criminal case u/s 156(3) Cr.P.C., in the local Magistrates court, seeking directions to the Police to investigate and file charge sheet.

Very well advised by experts, I fully agree and appreciate their acumen.
File a police complaint / FIR and wait for about few days for action, otherwise move to your area Magistrate through a local prudent lawyer for legal action against such goons.
Do not get perturbed by such nausty calls and repay your outstanding amount.
