Regarding power of attorney

(Querist) 23 February 2019 This query is : Resolved
In 2006 I gave someone a registered power of attorney to sell my land ..A stay in selling of land is granted by the court which was filed by my cousion brothers against me and my elder brother and the stay is still in force ..Now I want to cancel the power of attorney given to the said person .

In order that the power of attorney could not get cancelled can that man take a stay order restraining me to cancel my power of attorney given to him

Kindly advise

You can cancel your power of attorney anytime by registered instrument once again.
As far stay order for cancellation of POA is concerned that depends on the terms and conditions on which POA executed, if it was irrevocable, the court may stay the cancellation of POA. Till the stay granted to the attorney, you can go ahead with the cancellation process of the POA

No advice can be given unless the complete POA even if in Hindi read, simple heading tell only of simple power of attorney, whether it is revocable or irrevocable and what are terms and conditions with regards to it's validity can be confirmed after studying it properly, that's not possible like this in open forum, proper personal legal consultancy required for right advice on the matter.

You may better show the P.A. to local Lawyer or upload in this forum with your query, so that a considered opinion can be given.

1. You can unilaterally CANCEL /REVOKE the POA, by simply giving Legal Notice to the POA holder that POA granted to him is Revoked and that he should not do any action, whatsoever, based on the earlier POA. There is no need to take consent from the POA holder or anybody.

2. Also publish proper paper notice that the POA is Revoked that public should not deal with your earlier POA holder.
