Car parking for a tenant

(Querist) 02 January 2019 This query is : Resolved
I leave as a leave and license holder in a co. Op ho. Society for 5 years. there is open parking. Society has enough space for parking. But recently the chairman said nowin tenants can't park their cars in the society but an owner can park more than one car. So my question is there is any rule for leave and license holder to fight against that rule created by the society?

1. The tenant of a member of a Co-operative Housing Society can not park his vehicle in the Society premises if the resolution to the effect has been passed at the AGM of the Society.
2. The tenant has no legal right to challenge the Society.

The question is, whether the AGM has passed such a resolution. Admittedly, the President, on his own, cannot impose a rule or stipulation.

There is a larger issue: whether the Society's AGM is empowered by a Statute in passing such a resolution.

1. Tenant has got ALL the routine rights that is available to the registered member, to the exception of administrative and management membership functions.

2. Tenant should obtain consent letter from flat-owner, demand parking and on refusal file grievance petition before the local Consumer court.
